Most breathalyzer tests given during DWI stops are fairly universal. But they are still just machines, and machines can fail. If you believe that the breathalyzer test you were given at the time of your arrest was faulty, you may be able to easily contest your arrest. Also, human beings are quite fallible as well. If you believe the arresting officer read the breathalyzer test incorrectly, you will be able to contest your arrest.

Were you properly read your rights at the time of your arrest?

Having your Miranda rights are properly read to you is vital and you absolutely need to have them read to you and confirmed that you understood your rights at the time of your arrest is absolutely vital. If you were not read your rights at the time of your arrest, or if you did not verbally acknowledge that you understood them may be cause for your case to be thrown out during the arraignment process.

Being arrested for Driving While Intoxicated is a serious offense. If you are not defended properly, you could end up paying hefty fines, have your driver’s license revoked, do jail time, or in a worst case scenario, all three could occur. So when you’ve been arrested for DWI, it is important to communicate honestly and openly with your attorney so that they can defend you and your rights to the best of their ability.
